Important notice about rent increases and other June news

Important information on rent increases

Rent increase notices can be given now provided the increase takes effect after the six-month freeze period (after 25 September 2020, unless the legislation is extended).

Giving notice to increase the rent:

  • A landlord must give their tenant at least 60 days' written notice of a rent increase. Boarding house landlords must give their tenant at least 28 days' written notice.
  • The notice must be served in writing, say how much the rent is increasing by and the day the increased rent is due. The landlord should keep a copy of the notice.

Points to remember on rent increases

  • Landlords can only increase rent after the first 180 days of the tenancy provided the increase is not within 180 days of the last increase.
  • Landlords can only increase rent for fixed-term tenancies if the tenancy agreement allows this.
  • Special rules apply if a tenancy agreement is subject to an annual rent increase process

 

   

Initiatives to help landlords and tenants needed

Like everyone landlords are facing tough times due to the fall out of Covid-19. This includes loss of income, reduced wages and business losses. One way to help soften the blow for landlords, and consequently ease any increases in rents for tenants, would be to delay the introduction of the ring- fencing law which was introduced in June 2019. A few places available in the June 15 Education Program for Self Managing Landlords.

The third class for this very popular on line course is due to start on June 15.  A few places are still available so go here to register.  The program consists of 13 modules which can be easily managed within one month leading to the issuing of a Certificate of Completion at the end. NZPIF members have free access and the course is also open to NZPIF Associate Members and non-members for a fee of $300. However, it is important to emphasise that registering as a full member of a local Property Investors' Association affiliated to the NZPIF will enable free access to the course.

 

 

Extension for Healthy Homes Compliance Statement requirement

Sharon Cullwick, NZ Property Investors' Federation (NZPIF) Executive Officer, welcomes the Government's extension of the deadline requiring landlords to provide Healthy Homes Compliance Statements. The original date was the 1st July 2020 and this date has been extended until the 1st of December 2020.

"However," Cullwick says "landlords are still facing serious challenges. Although the date to provide these Statements has been extended, there has been no extension of the final date of 1 July 2024 for rental properties to be fully compliant under the Healthy Homes Standards".
